What is Workers' Compensation?

The workers' compensation system was designed to provide security and peace of mind to workers that they would be fairly compensated in the event they were injured on the job. Workers' compensation is not a fault-based system. In other words, you do not have to prove that your injury was caused because your employer or another worker was negligent in order to receive compensation. In exchange for this security, workers' compensation is the exclusive recourse against the employer for a workplace injury. You are not allowed to sue your employer, and instead of the types of damages you could recover in civil court, you are limited to the statutory amount established for your injury.
So what are you entitled to under workers' compensation? The costs of your medical care, including rehabilitation, may be paid by your employer. In addition, you can receive payments for lost wages covering the time it takes you to recover (temporary disability) or in the event you don't recover and can no longer work (permanent disability). You may also be entitled to vouchers to help pay for job retraining if you can no longer work for your current employer but may be able to perform a different job.

How We Can Help

Although worker's compensation sounds like a sure thing, that is not always the case. Your claim may be rejected by the workers' compensation judge and you may need to appeal to the Workers' Compensation Appeals Board. Even if your claim is accepted, you may be given an incorrect rating for your disability, and you may have to go before the judge with evidence and medical testimony to prove your case. This process is very much like taking a case to court, and having competent, experienced legal representation is nearly always essential to making sure your case is presented in the best light possible and that your legal rights are protected at every step.
At Law Offices of James M. Bader, we help you through the whole process related to your injury. Of course we will represent you before the judges and the appeals board, but we will also help you find the best doctor for your condition, handle problems with the insurance company, and make sure that your claim is processed quickly and accurately, so that you begin receiving your payments sooner rather than later. If you have been injured on the job, give us a call or come on in to our office, and let's talk about your case and how we can help you get the appropriate workers' compensation for your workplace injury.
